NEBRASKA FRANCHISE LAWS

Franchise Registration in Nebraska.  There is no state franchise registration required in Nebraska.

 

Business Opportunity Exemption Registration in Nebraska.  The Nebraska Seller-Assisted Marketing Plan Act is broad enough to cover most business format franchises.  Nebraska Revised Statutes Section 59-1703There is an exemption for franchisors that comply with the FTC Franchise Rule and that file for the exemption in Nebraska.  Nebraska Revised Statutes Section 59-1722.

The one-time exemption registration filing fee is $100.  The Nebraska regulator’s web site is here.

Franchise Disclosure in Nebraska.  Nebraska has no state franchise disclosure laws.  So, there are no special state disclosures required in an FDD used in Nebraska.

 

Franchise Relationship Law in Nebraska.  The Nebraska Franchise Practices Act includes restrictions and requirements regarding termination, non-renewal, non-competition, franchisee transfers, waiver, free association, management, equity, and performance standards.  Nebraska Revised Statute Sections 87-404, 87-405 and 87-406.
