LOUISIANA FRANCHISE LAWS

Franchise Registration in Louisiana.  There is no state franchise registration required in Louisiana.

 

Business Opportunity Exemption Registration in Louisiana.  There is an exemption under Louisiana business opportunity law for the sale of franchises for an initial payment exceeding $300 in which the franchisor represents that it will “provide a sales plan or marketing program which will enable the purchaser to derive income from the business opportunity which exceeds the price paid for the business opportunity.”  Louisiana Revised Statutes 51:1821(1).

If the franchise involves a mark that is registered with the U.S Patent and Trademark Office or with Louisiana, then this exemption is automatically effective and does not require any filing.  Louisiana Revised Statutes 51:1821(1).

 

However, if the franchise does not involve the licensing of a federal or state registered mark, then the franchisor would need to comply with Louisiana business opportunity law.

 

Franchise Disclosure in Louisiana.  Louisiana has no state franchise disclosure laws.  So, there are no special state disclosures required in an FDD used in Louisiana.

 

Franchise Relationship Law in Louisiana.  Louisiana has no state franchise relationship laws for business format franchises.
