FLORIDA FRANCHISE LAWS
Franchise Registration in Florida. There is no state franchise registration required in Florida.
Business Opportunity Exemption Registration in Florida. The Florida Sale of Business Opportunities Act includes an exemption for franchises meeting the federal definition of a franchise under the FTC Franchise Rule. Florida Statutes Section 559-802(1).
To claim the exemption, the franchisor must file the required exemption form in Florida and pay the annual filing fee of $100. The required form with instructions is here.
Franchise Disclosure in Florida. Florida has no state franchise disclosure laws requiring certain disclosures. So, there are no special state disclosures required in an FDD used in Florida. However, Florida law does make it unlawful for a franchise seller to intentionally misrepresent or fail to disclose certain information in connection with the sale of certain types of franchises. Florida Statutes Section 817.416.
