Franchise Registration in Delaware. There is no state franchise registration required in Delaware.
Business Opportunity Exemption Registration in Delaware. There is no state business opportunity exemption registration required for franchises in Delaware.
Franchise Disclosure in Delaware. Delaware has no state franchise disclosure laws. So, there are no special state disclosures required in an FDD used in Delaware. The FTC Franchise Rule governs.
Franchise Relationship Law in Delaware. The Delaware Franchise Security Law appears to be broad enough to cover certain types of business format franchises. It prohibits unjust terminations and non-renewals, and requires 90 days’ notice of termination or non-renewal. Delaware Code, Title 6, Sections 2551 - 2557.
