ALASKA FRANCHISE LAWS

Franchise Registration in Alaska.  There is no state franchise registration required in Alaska.

 

Business Opportunity Exemption Registration in Alaska.  There is an exemption under Alaska business opportunity law for franchises.  This exemption is automatically effective and does not require any filing.  Alaska Statutes Section 45.66.220(2).

 

Franchise Disclosure in Alaska.  Alaska has no state franchise disclosure laws.  So, there are no special state disclosures required in an FDD used in Alaska.

 

Franchise Relationship Law in Alaska.  Alaska distributorship laws appear broad enough to cover certain business format franchises.  Those laws: (1) prohibit a distributor (franchisor) from attempting to coerce a dealer (franchisee) to perform certain acts by using duress or threatening termination; (2) require the distributor (franchisor) to repurchase from the dealer (franchisee) certain unused merchandise, repair parts, assets and machinery following certain terminations; and (3) prohibits waiver of jury trials, requirements for the payment of the distributor’s (franchisor’s) attorney fees, and the selection of any governing law other than Alaska law.  Alaska Statutes Section 45.45.700 – 790.
